Supreme Court Finds Unconstitutional Bias Against a Christian Charity in Wisconsin

Supreme Court Overturns Wisconsin Ruling in Religious Tax Exemption Case

The nation’s highest court handed a decisive win to a Wisconsin-based Catholic charity in a dispute over state unemployment tax credits for religious institutions. The case, which centered on whether state criteria improperly denied faith-based groups a tax exemption, has significant implications for religious entities across the country.

In a unanimous decision, the justices ruled that the state had created an “unnecessary entanglement” by attempting to determine if a religious organization qualified for an otherwise available tax benefit. They maintained that when the government discriminates among religions based on theological differences in service provision, it imposes a denominational bias that must meet the highest level of judicial review.

Justice Sonia Sotomayor, writing for the majority, explained, “When the government distinguishes among religions based on theological differences in their provision of services, it imposes a denominational preference that must satisfy the highest level of judicial scrutiny.” She continued that Wisconsin’s failure to appropriately tailor its approach meant that the state’s actions could not withstand this rigorous standard.

The court reversed the decision of the Wisconsin Supreme Court and remanded the case for further proceedings consistent with the federal opinion. Previously, the state court had determined that the Catholic charity did not operate primarily for religious purposes because it served a diverse community and did not actively seek to instill its faith in program participants.

This ruling marks a significant victory for religious organizations, affirming that government practices must not favor one faith over another and must respect First Amendment protections. The decision is being closely watched as it could influence how religious exemptions are applied in other states.
